Terms of Service

By accessing or using the Shunpanda platform — including our website, mobile applications, and any related services (collectively, the "Service") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

Shunpanda is a logistics platform that connects businesses and individuals ("Customers") with independent professional drivers ("Drivers") to facilitate on-demand and scheduled delivery services.

Shunpanda acts as a technology intermediary and is not itself a transport or logistics provider. Delivery services are performed by independent Drivers who are not employees or agents of Shunpanda.

To access most features of the Service, you must create an account. You agree to:

• Provide accurate, complete, and current registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 18 years old to register. Accounts registered on behalf of organisations must be created by an authorised representative.

Drivers who register on the platform agree to additional terms, including:

• Maintaining a valid driver's licence and roadworthy vehicle at all times
• Completing the required onboarding and verification process
• Operating as an independent contractor, not an employee of Shunpanda
• Complying with all applicable road traffic laws and regulations
• Maintaining appropriate vehicle insurance
• Treating customers and their goods with care and professionalism

Shunpanda reserves the right to suspend or terminate driver accounts for non-compliance, poor performance, or fraudulent activity.

Customers using the platform to book deliveries agree to:

• Provide accurate delivery information including addresses and package details
• Ensure packages are lawful, appropriately packaged, and safe to transport
• Not use the Service to transport prohibited items (see Section 6)
• Pay all applicable fees at the time of booking
• Treat drivers respectfully and professionally

The following items may not be transported using the Shunpanda platform:

• Illegal substances, narcotics, or controlled goods
• Weapons, ammunition, or explosives
• Hazardous materials (unless explicitly approved in writing)
• Live animals (without prior written approval)
• Stolen goods or items obtained through illegal means
• Any item whose transport would violate applicable law

Shunpanda reserves the right to report suspicious activity to relevant authorities.

Delivery fees are displayed to customers before booking confirmation. Fees are charged at the time of booking.

Drivers receive payouts on a weekly basis for completed deliveries, less Shunpanda's platform fee. The current fee schedule is available in the driver app.

All payments are processed by our third-party payment providers. By making a payment, you agree to their terms and conditions.

Refunds are handled on a case-by-case basis. Contact support@shunpanda.com for refund requests.

The Service is provided "as is" without warranties of any kind, express or implied.

Shunpanda does not guarantee: - The availability, reliability, or performance of any Driver - That deliveries will be completed on time or without incident - That the platform will be uninterrupted or error-free

To the maximum extent permitted by law, Shunpanda's liability for any claim arising from use of the Service is limited to the amount you paid for the delivery in question.

Shunpanda is not liable for loss, damage, or delay of goods beyond reasonable care, or for any indirect, incidental, or consequential damages.

All content, trademarks, and technology on the Shunpanda platform are the exclusive property of Shunpanda, Inc. or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

Shunpanda may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may close your account at any time by contacting us.

Upon termination, your right to use the Service ceases immediately. Sections relating to liability, intellectual property, and dispute resolution survive termination.

These Terms are governed by and construed in accordance with the laws applicable in the jurisdiction where Shunpanda, Inc. is incorporated. Any disputes shall be resolved through binding arbitration or in the competent courts of that jurisdiction.
